In November 1996, he was elected to the other seat of Senator and succeeded the Republican incumbent, Mark Hatfield. He was re-elected in 2002. September 7, 2003, Garret Smith, eldest son of 21 years committed suicide. In 2004, President George W.Bush ratifies law Garrett Lee Smith Memorial enacting a $82 million on the suicide prevention program in college. June 13, 2005, Smith is one of the 17 senators who refuse to support a resolution of the Senate apologizing to the black community for having refused to legislate on lynching in the 1920s and 1940s. Candidate to his re-election, he gets 46% of the vote and was defeated by Democrat Jeff Merkley (49%) on November 4, 2008.
